These Terms of Service ("Terms") govern your use of the usefae.com website operated by Fae Software Limited ("Fae", "we", "us", or "our"), and your purchase and use of software we sell here. By accessing our website or buying our software, you agree to these Terms.
This website provides information about Fae Software Limited, our software products, our portfolio of past work, and the design and development services we offer. It also lets you buy licenses for some of our software. Section 4 covers those purchases; the rest of the website is provided for informational purposes.
Case studies and portfolio content describe work we have completed. They are illustrative and do not constitute a guarantee of any particular result, timeline, or outcome for any other project.
Nothing on this website constitutes an offer to provide services, and no client relationship is created by browsing this website, submitting an inquiry, or booking an introductory call.
Any design or development engagement is governed exclusively by a separate written agreement signed by both parties, which sets out scope, deliverables, timelines, fees, ownership, and confidentiality. Where that agreement conflicts with these Terms, that agreement governs.
Bench is a Mac app for ESP32 firmware, made by Fae and sold with a license key on usefae.com/bench. This section covers buying it and using it, and applies to any other app we sell the same way.
Orders are processed by Stripe. Your order is sold through Link, Stripe’s checkout and payment service, which is the merchant of record for the sale: the checkout page and your receipt say “Sold through Link”, and your card statement shows LINK.COM* followed by our name. Link takes your payment, works out and collects sales tax, VAT or GST where it applies in the countries it covers, sends your receipt, and can help with questions about the payment itself; its own terms apply to that part. Fae makes Bench, issues your license key, and looks after the app and its support.
In a country Link doesn’t cover for tax, Link still takes your payment, but your invoice may carry Fae Software Limited’s name and tax details, because Fae is responsible for any tax there. If checkout doesn’t say “Sold through Link” at all, Fae Software Limited is the seller and Stripe only processes the payment for us.
Prices are in US dollars and don’t include sales tax, VAT or GST. Checkout adds any tax that applies where you live and shows the total before you pay. It may also show the total in your own currency and let you pay in it.
Your purchase includes one year of updates and email support, starting on the day you buy. After that year, Bench keeps working, for good, including every update released during your year. Updates released after that may need a paid renewal.
You can try Bench free for 30 days before you buy. The trial is the whole app, lives in the app, and needs no account or payment. After 30 days Bench still opens, shows your boards and the console, and inspects; building and flashing need a license.
If Bench isn’t right for you, email hello@usefae.com within 30 days of buying and we will refund you in full. No questions asked. A full refund, whether it comes from us or from Link, disables the license key. If a payment is disputed with your bank, the key is paused while the dispute is open, and disabled if the bank returns the payment. None of this affects any right to cancel that you have under the law where you live.
Bench checks its license with usefae.com when you enter your key and from time to time after that. Bench does not stop working just because it cannot reach usefae.com. Our Privacy Policy says what these checks send and what we keep. Fae can see how many Macs a key is used on, and may disable a key that has been refunded, shared or published, or that is used on more Macs than one person would use. If that happens to you by mistake, email us and we will put it right.
If you contact us by email or book a call through this website, you consent to us replying to you about your inquiry. If you buy software from us, we will email you your license key and messages about your purchase. We do not operate a marketing mailing list and will not add you to one.
The content on this website, including text, graphics, product names, and case study material, is owned by Fae Software Limited. You may not resell, redistribute, or claim it as your own work.
Third-party names, trademarks, and game titles referenced in our case studies remain the property of their respective owners. Their appearance here is descriptive and does not imply affiliation or endorsement.
Nothing on this website constitutes professional business, legal, financial, or technical advice. The information we provide is for general informational purposes. Always consult qualified professionals before making significant business decisions.
This website and our software are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the website or the software will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
To the fullest extent permitted by law, Fae Software Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our software. Our total liability for any claim arising from your use of this website shall not exceed $100 CAD, and for any claim about software you bought from us, the amount you paid for it.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms. A change never takes away a license you have already bought.
